We process personal data only where an applicable legal basis exists. Depending on the circumstances, these bases include:

We use relevant information to process purchases, arrange delivery, provide facilitation or customisation services, communicate about orders, and manage customer accounts.

Subject to applicable cookie and privacy requirements, we may use Google Analytics, Google advertising services, Meta advertising tools and related technologies to understand website use, measure campaigns and improve our marketing.
Where consent is required, these technologies will remain inactive until valid consent has been obtained. You can change your preferences through the website’s cookie settings.

2.5 Cookies and similar technologies
The website may use strictly necessary cookies and, where enabled, analytics, advertising and other non-essential technologies.
Non-essential cookies and similar technologies will be used only in accordance with applicable consent requirements. You should be able to accept or reject non-essential cookies with equally accessible options and adjust your choices later.
For further information about the specific cookies, providers, purposes and retention periods used on this website, please consult our cookie policy at the end of this page and the website’s cookie settings.
2.6 Who receives your data?
Depending on the transaction and website configuration, relevant information may be shared with:
- Website hosting and technical-support providers.
- WooCommerce and relevant website-service providers.
- Order fulfilment, shipping and delivery companies.
- Email and newsletter service providers.
- Analytics and advertising providers, where lawfully enabled.
- Professional advisers, auditors and public authorities where required by law.
We do not authorise service providers to use personal data for unrelated purposes merely because they provide services to Gate. Appropriate contractual and legal safeguards will be implemented where required.
2.7 International transfers
Because Gate serves customers internationally and may use providers operating in different countries, some personal data may be transferred outside the European Economic Area.
Where such transfers occur, we will ensure that an applicable legal transfer mechanism is in place, such as an adequacy decision or appropriate safeguards under the GDPR, where required.
Information about relevant safeguards may be requested using the privacy contact details above.
2.8 How long we retain data
We retain personal data only for as long as necessary for the relevant purposes, taking account of contractual requirements, applicable retention periods, legal obligations and the establishment or defence of legal claims.
In general:

Subject to applicable legal conditions, you may have the right to:
- Request access to your personal data.
- Request correction of inaccurate or incomplete data.
- Request erasure of your data.
- Request restriction of processing.
- Object to processing based on legitimate interests.
- Request data portability where applicable.
- Withdraw consent at any time, without affecting the lawfulness of processing before withdrawal.
- Object to direct marketing at any time.
To exercise your rights, email hola@gatesimulation.com. We may need to verify your identity proportionately before acting on a request.
You also have the right to lodge a complaint with the competent data protection authority. In Spain, this is the Agencia Española de Protección de Datos (AEPD), whose website is https://www.aepd.es/.
2.10 Security
We implement appropriate technical and organisational measures designed to protect personal data against unauthorised access, loss, alteration or disclosure.
No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
2.11 Children’s data
Gate is a professional business simulation product and is not directed at children. We do not knowingly collect children’s personal data for marketing purposes. If you believe that a child has provided personal data to us, please contact us so that we can assess the appropriate action.
2.12 Changes to this Privacy Policy
We may update this policy when our practices, service providers or legal obligations change. The latest version will be published on this website with its updated revision date.
3. REFUNDS, RETURNS AND CANCELLATIONS POLICY
3.1 Scope
This policy applies to purchases made through the Gate website, including:
- Gate: the physical simulation game and printed materials.
- Gate Facilitated: the game and associated facilitation services.
- Gate Premium: the game, facilitation and customised simulation services.
This policy distinguishes between consumers purchasing mainly for purposes outside their trade or profession and business customers purchasing for professional purposes.
Mandatory statutory rights always take precedence over any conflicting provision in this policy.
3.2 Right of withdrawal for consumers
If you are a consumer purchasing online and the applicable law grants you a right of withdrawal, you may generally withdraw from your purchase without giving a reason within 14 days.
For physical goods, the period generally begins on the day you, or a person designated by you other than the carrier, receive the goods.
For service contracts, the period generally begins on the day the contract is concluded.
To exercise your right, send an unequivocal withdrawal statement to:
Email: hola@gatesimulation.com
Please include your name, order number, the product or service concerned, and a clear statement that you wish to withdraw.
You may use the model withdrawal form provided below, but you are not required to use it.
3.3 Returning physical products
Where a consumer validly exercises a statutory right of withdrawal for physical goods:
- Please return the goods without undue delay and within the period required by applicable law.
- Unless the goods are faulty or another rule applies, you are responsible for the direct cost of returning them, provided this obligation was disclosed before purchase.
- You may handle and inspect the goods to the extent reasonably necessary to establish their nature, characteristics and functioning.
- You may be liable for diminished value resulting from handling beyond what is necessary for such inspection, where the law permits.
Please contact us before sending a return so that we can provide the correct return instructions.
Return address: Delivery address of the shipping received by the buyer
Do not send goods to an address that has not been confirmed by Gate.
3.4 Refunds for valid withdrawals
Where a statutory withdrawal is valid, we will reimburse the amounts required by applicable law, including the applicable standard delivery cost where required.
Refunds will generally be made using the original payment method unless otherwise agreed lawfully.
For physical goods, we may withhold reimbursement until we have received the goods back or you have supplied evidence that they have been sent back, whichever occurs first, where permitted by law.
We will process refunds within the applicable statutory deadline.
3.5 Exceptions to the right of withdrawal
The statutory right of withdrawal is subject to specific legal exceptions. Depending on the circumstances, exceptions may apply to:
- Goods made to the consumer’s specifications or clearly personalised.
- Services that have been fully performed, where the consumer’s prior express consent and acknowledgement of the loss of the withdrawal right have been obtained as required by law.
- Services started during the withdrawal period at the consumer’s express request, where applicable rules permit a proportionate charge for the part performed and the required information and acknowledgements were obtained.
Customisation does not automatically remove a consumer’s withdrawal right. Gate will rely on an exception only where the particular product or service and the applicable legal conditions genuinely qualify.
For Gate Premium orders, any applicable exception and the effect of starting customisation will be explained before purchase and expressly acknowledged where required.
3.6 Gate Facilitated and Gate Premium service cancellations
Customers purchasing facilitation or customisation services will receive the applicable service scope, scheduled dates, fees and cancellation terms before confirming the order.
The following proposed cancellation schedule is subject to confirmation in the order terms:
- More than 14 calendar days before the scheduled service: cancellation without a contractual cancellation fee, subject to statutory rights and any lawful costs specifically agreed in advance.
- Between 7 and 14 calendar days before the scheduled service: a cancellation fee of 50% applies, proportionate and legally enforceable.
- Less than 7 calendar days before the scheduled service, or failure to attend: a cancellation fee of 90% applies, proportionate and legally enforceable.
These contractual terms do not remove or shorten any mandatory consumer withdrawal right. They also do not apply where prohibited by law.
For customised work already started, Gate will assess any legally recoverable amount in accordance with the applicable contract and consumer law. No blanket non-refundable rule applies merely because a product is described as customised.
3.7 Faulty, damaged or non-conforming products
The withdrawal right is separate from your statutory rights where a product is faulty, damaged or does not conform to the contract.
If your Gate product arrives damaged or does not conform to the agreed description, please contact hola@gatesimulation.com and include your order number and, if useful, photographs of the issue.
Consumers retain their mandatory legal remedies, which may include repair, replacement, price reduction or termination of the contract and refund, depending on the circumstances and applicable law.
Where a remedy is required by law, Gate will not charge the consumer costs that the law requires the seller to bear.
In Spain, consumer goods generally benefit from a three-year statutory conformity guarantee for purchases covered by the applicable rules, subject to the relevant legal conditions.
Nothing in this policy limits mandatory statutory rights.
3.8 Business-to-business purchases
Where a customer purchases Gate products or services for business or professional purposes, statutory consumer withdrawal rights generally do not apply.
Cancellation, returns, refunds and any remedies for non-conformity will be governed by the agreed business contract and applicable law, subject to any mandatory provisions.
Business customers should contact hola@gatesimulation.com to discuss a cancellation or issue with an order.
3.9 International orders, shipping and customs
Gate sells internationally, subject to available delivery destinations and applicable restrictions.
Delivery charges, estimated delivery times, taxes and any additional charges will be displayed or explained before the order is confirmed, as applicable.
For deliveries outside the European Union, the customer may be responsible for import duties, customs charges, local taxes or clearance fees unless the checkout or order terms expressly state otherwise.
International shipping and customs arrangements do not remove any mandatory consumer rights that apply to the transaction.
3.10 How to contact us about a return or refund

Include your order number and a description of your request. We will respond within a reasonable time and in accordance with applicable legal deadlines.

Strictly necessary cookies do not require consent where they meet the applicable legal exemption. They are not used for unrelated advertising purposes.
3.2 Functional and preference cookies
These cookies remember choices you make, such as language or other website preferences, and may improve your browsing experience.
Where a functional cookie is not strictly necessary and does not qualify for an applicable exemption, we will request your consent before using it.
3.3 Analytics and performance cookies
Where you consent, we may use analytics technologies, including Google Analytics, to understand how visitors interact with the website.
These technologies may help us understand:
- Which pages and products attract interest.
- How visitors navigate the website.
- Whether website features are working correctly.
- How we can improve the usability and performance of the online shop.
Analytics information may include pages visited, session information, device and browser details, approximate location derived from technical information, and interactions with website content.

Where you consent, we may use Google Ads, Meta advertising tools, including the Meta Pixel, and related technologies to:
- Measure the performance of advertising campaigns.
- Understand whether visitors interact with our website after seeing an advertisement.
- Improve the relevance of our advertising.
- Create or use audiences for advertising, where permitted.

These technologies may allow relevant providers to receive information about your device, browsing activity and interactions with Gate’s website. Depending on the services and settings used, this information may be associated with identifiers or accounts maintained by those providers.
We will not activate consent-dependent advertising technologies before obtaining valid consent where required by law.
4. Legal basis for using cookies
Under applicable Spanish and EU rules, strictly necessary cookies may be used without consent where they are exempt from the consent requirement.
For non-essential cookies and similar technologies, we will request your consent before storing or accessing information on your device where the law requires it.
Where personal data are processed through cookies, the applicable data protection rules also apply. Consent, where required, must be freely given, specific, informed and unambiguous.
You can refuse non-essential cookies without being required to accept them to access the website’s ordinary functions, except where a particular service is lawfully and transparently offered subject to different conditions.
5. Third-party providers
Depending on the services enabled on our website, third-party providers may include:
- Google: analytics and advertising services.
- Meta: advertising measurement and audience-related services.
- WooCommerce and related website providers: online shop functionality and essential technical operations.
The actual providers and technologies used may change as our website develops.
Third-party providers may process information under their own privacy terms and, where applicable, act as independent controllers or processors. Their processing activities are subject to the relevant contractual arrangements and applicable law.

6. Cookie duration
Cookies may be either:
- Session cookies, which generally expire when you close your browser.
- Persistent cookies, which remain on your device until they expire or are deleted.
The duration depends on the particular cookie, its purpose and the provider’s settings.
The actual cookies used by Gate, including their names, providers, purposes and expiry periods, should be listed in the cookie details available through our cookie-consent interface.
7. Managing your cookie preferences
When you first visit our website, you will be presented with a cookie-consent interface that allows you to manage your preferences.

Accepting and rejecting non-essential cookies will be presented with equally accessible options.
You can withdraw or change your consent at any time by selecting “Cookie Settings” or “Manage Cookie Preferences” through the link available on our website.
Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.
Please note that blocking strictly necessary cookies through your browser may affect the operation of certain website features, including shopping-cart or checkout functionality.
8. How to delete cookies through your browser
Most web browsers allow you to view, delete or block cookies through their settings.
You can usually find these options in the privacy or security section of your browser settings. The exact procedure depends on the browser and device you use.
Deleting cookies through your browser does not necessarily withdraw consent recorded by Gate or prevent new cookies from being set during a future visit. To manage your preferences for Gate specifically, please use our cookie-settings interface.
9. International transfers and personal data
Some third-party cookie providers may process information outside the European Economic Area.
Where personal data are transferred internationally, Gate will ensure that any transfer for which it is responsible complies with applicable data protection requirements, including the use of an appropriate transfer mechanism where required.
